Les 21 et 22 mars, s’est déroulée la 28ème édition du Forum de la Propriété intellectuelle au Pavillon Dauphine. Cet événement très attendu qui a rassemblé plus de 350 participants, acteurs majeurs de l’univers de la propriété intellectuelle, pour répondre à la question suivante : Quels bouleversements législatifs, numériques, technologiques et pratique pour la propriété intellectuelle ?
Tour à tour, des personnalités reconnues dans l’écosystème de la lutte anti-contrefaçon se sont exprimées afin d’éclairer et de donner une ligne directrice aux interventions d’éminents orateurs, invités à échanger et débattre durant ces 2 journées. Ainsi, Christophe Blanchet, Député du Calvados et Président du Comité National Anti-Contrefaçon (CNAC), a salué les avancées législatives en matière de propriété intellectuelle et notamment par la publication du Plan Anti-Contrefaçon présenté par Thomas Cazenave, Guillaume Vanderheyden, Sous-directeur du commerce international de la Douane française, a souligné l’implication de l’administration douanière pour protéger et promouvoir l’authentique, Pierre Hoffman, Bâtonnier, a partagé sa réflexion concernant l’anticipation des nouveaux défis auxquels il faut faire face pour défendre ce droit, Pascal Faure, Directeur général de l’INPI et enfin Joao Negrao, Directeur exécutif de l’EUIPO, ont souligné la collaboration établie entre les organisations publiques internationales et le secteur privé dans la lutte contre la contrefaçon, transcendant nos frontières en mettant en valeur l’impact de la législation française sur la propriété intellectuelle dans le monde.
Les premiers échanges ont débutés avec « les événements sportifs de 2024 », réunissant la DIJOP, la MICAF, la DGDDI, Paris 2024 pour aborder les défis de la contrefaçon accompagnant l’arrivée imminente des Jeux Olympiques. Formation des agents opérationnels et opérations de répression « coup de poing » ont été les principaux axes évoqués.
Le sujet de la protection de la propriété intellectuelle en Europe a lui aussi été abordé par les titulaires de droit soulignant la nécessité d’une meilleure réglementation, notamment en ce qui concerne la directive sur les emballages et des déchets d’emballages, la révision des dessins et modèles et la loi influenceurs, ainsi que la nouvelle tendance émergeante sur les réseaux sociaux des Dupes.
Les implications de l’IA, ses opportunités et ses risques, ont été évoqués par la Direction Générale des Entreprises (DGE), des titulaires de droits engagés, des experts juridiques, des spécialistes du sujet, ainsi que les pouvoirs publics à travers la Gendarmerie Nationale.
Le dernier thème majeur de cette édition s’est porté sur le Digital Services Act (DSA) et son application, marques, plateformes mais aussi Arcom et DG Connect ont pu exprimer leur vision aborder les diverses actions entreprises et ce qu’il reste à faire pour s’assurer d’une protection optimale en ligne, notamment avec la question des signaleurs de confiance.
Il a également offert aux participants, l’opportunité d’interagir avec les experts internationaux de l’Unifab venus du monde entier, partageant des bonnes pratiques et évolutions législatives propres à leurs zones respectives.
Ce Forum a été également été le témoin de la remise des Unifab Awards, prix dédié à récompenser la plus belle décision de justice de l’année 2023, à HERMES et au BNIC. Cette remise de prix fait suite aux délibérations d’un éminent jury composé du CEIPI, de l’EUIPO, du CAGC, de l’APRAM et de la CNCPI.
Pour clôturer cet évènement, une convention de partenariat avec la Police Nationale à été signée entre l’Unifab et la Police Nationale – afin de sceller leur alliance dans la lutte anti-contrefaçon.

On March 21st and 22nd, the 28th edition of the Intellectual Property Forum took place at the Pavillon Dauphine. This highly anticipated event, which brought together over 350 participants, key players in the intellectual property field, aimed to address the following question: What legislative, digital, technological, and practical disruptions are affecting intellectual property?
Throughout the two days, renowned figures in the anti-counterfeiting ecosystem expressed their views and provide guidance for the interventions of eminent speakers invited to exchange and debate. Christophe Blanchet, French Member of Parliament for Calvados and President of the French Anti-Counterfeiting Committee (CNAC), commended legislative advancements in the field of intellectual property, particularly citing the Anti-Counterfeiting Plan presented by Thomas Cazenave. Guillaume Vanderheyden, International Trade Deputy Director, emphasised the customs administration’s commitment to protecting and promoting authenticity. Pierre Hoffman, President of Paris Bar, shared his reflections on anticipating the new challenges that must be faced to defend this right. Pascal Faure, Director General of the INPI, and Joao Negrao, Executive Director of the EUIPO, highlighted the collaboration between international public organizations and the private sector in combating counterfeiting, transcending our borders and showcasing the impact of French legislation on intellectual property worldwide.
The first discussions began with « the 2024 sports events, » bringing together DIJOP, MICAF, DGDDI, and Paris 2024 to address the challenges of counterfeiting accompanying the imminent arrival of the Olympic Games. The main topics discussed were the training of operational agents and « blitz » enforcement operations.
The topic of intellectual property protection in Europe was also addressed by rights holders, emphasizing the need for better regulation, particularly regarding the directive on packaging and packaging waste, the revision of designs and models, the influencer law, as well as the emerging trend on social networks of Dupes.
The implications of AI, its opportunities, and risks were discussed by the Directorate General for Enterprises (DGE), committed rights holders, legal experts, subject specialists, as well as public authorities through the National Gendarmerie.
Finally, the last major theme of this edition focused on the Digital Services Act (DSA) and its implementation. Brands, platforms, as well as Arcom and DG Connect, expressed their views and addressed the various actions taken and what remains to be done to ensure optimal online protection, particularly concerning the issue of trusted flaggers.
The event also provided participants with the opportunity to interact with international experts from the Unifab, who came from around the world, sharing best practices and legislative developments specific to their respective areas.
This Forum also witnessed the presentation of the Unifab Awards, a prize dedicated to honoring the best legal decision of the year 2023, awarded to HERMES and BNIC. This award ceremony follows the deliberations of a distinguished jury composed of CEIPI, EUIPO, CAGC, APRAM, and CNCPI.
To close this event, a MoU between Unifab and Police has been signed to ensure their alliance in the fight against counterfeiting.
